EXCESS & UMBRELLA

Trucking Umbrella or Excess Liability Insurance is an essential coverage option for truckers and trucking fleets. Auto Liability Coverage

Auto liability insurance coverage helps cover the costs of the other driver’s property and bodily injuries if you’re found at fault in an accident.

The auto liability coverage definition may sound simple enough, but here’s a real life example: you’re at a four-way stop a few blocks from your house. You’ve done this route hundreds of times, so you don’t notice that it’s technically the other car’s turn to go – until it’s too late. The next thing you know; you’ve smashed into another driver’s car in the middle of the intersection.

We will work with the other driver’s insurance company to determine who is at fault (if you live in a no-fault state). If you have liability insurance, we will cover costs for the driver’s damaged car, minus your deductible, and up to your covered limit.

What does auto liability insurance cover?

Liability insurance actually consists of two types of auto coverage:

  • Bodily injury liability protection applies to the medical expenses of the other party if you are found at fault in the accident. In some circumstances, it may even cover lost wages and/or legal fees if the injured party files a lawsuit.
  • Property damage liability protection applies to damages to property resulting from a covered accident in which you’re at fault. It may cover the other party’s vehicle repair or replacement costs, as well as other property that may have been damaged in the accident, such as fences, structures, phone poles and other types of property.

Minimum liability limits for each of these coverage types vary depending on which state you live in. Liability coverage cannot be used to pay for your vehicular damage or personal injury costs. For that, you will need comprehensive and/or collision coverage.

FLATBED TRUCK INSURANCE

Flatbed trucks may carry any number of materials, from construction materials to sheet metal, heavy machinery and oil field equipment. Often flatbed trucks will carry oversized loads which require special state permits.

The most common accidents involving flatbed trucks are cargo shifting and cargo spills, so the focus of our flatbed truck insurance policies is to provide comprehensive coverage for when these incidents arise.

A well-tailored Flatbed Truck Insurance policy contains these coverages:

 

  • Comprehensive – protects your tractor and flatbed trailer against fire, theft, vandalism and other causes of loss.

  • Combined Deductibles – this coverage allows you to pay only one deductible in the event a loss occurs involving both physical damage and cargo.
  • Loading & Unloading – provides coverage for the commodity while it is being loaded or unloaded.
  • Debris Removal – provides coverage for reasonable and necessary costs to remove debris caused by and resulting from a covered loss.
  • Broadened Pollution – provides liability coverage for the discharge of pollutants which are in, upon, owned, being transported by, loaded or unloaded from a covered auto.
  • Earned Freight – replaces income lost when a load cannot be delivered due to a covered cargo loss.
  • Sue and Labor – covers costs related to preventing further loss to damaged cargo. Also known as loss mitigation.

Insurance Coverages You Need 

  1. A well-designed Hazmat Truck Insurance policy contains these coverages:
  • Pollution Liability (CA9948) — this endorsement provides coverage for cleanup expenses due to an accident, including damages arising out of the discharge of pollutants which are in, upon, owned, being transported by, loaded or unloaded from a covered auto. Every well-designed hazmat truck insurance policy should contain this provision.
  • Excess Liability — provides an additional layer of liability coverage in excess of the hazmat trucker’s primary liability limits, up to $50,000,000.

  • Downtime — you can add downtime coverage to your physical damage policy to provide added protection against lost income if you have a covered loss. Downtime coverage can help you keep your truck payment and other bills current if a covered loss renders your vehicle inoperable for an extended period of time. Most of our carriers offer downtime limits of $100 per day up to 35 days, subject to policy limitations.
  • Loan or Lease Gap — sometimes trucks and trailers depreciate faster than the equipment financed value. Loan or lease gap coverage can help assure that a total vehicle loss does not leave you “upside down” on your loan or lease.
  • Truck Rental Reimbursement — having a collision or comprehensive loss doesn’t mean you have to stop working. When you add truck rental reimbursement coverage to your physical damage policy you can rent a replacement truck and trailer and receive reimbursement for a large part of the rental cost.

NON TRUCKING INSURANCE

Non-Trucking Liability Insurance (NTLI) provides coverage in case you cause an accident while you are using your vehicle for non-business or personal use other than transporting goods or merchandise. Non-Trucking Liability coverage does not apply when you are pulling a loaded trailer, operating on behalf of a motor carrier / leasing company, or using a vehicle for any revenue generating purpose. These types of activities are covered by primary liability coverage. If a motor carrier is providing your primary liability coverage, their coverage will not apply when you are not under dispatch and you’ll need non-trucking liability coverage.

Non-Trucking provides protection for:

  1. The owner-operator, for liability when driving the tractor while not in the business of trucking;

The motor carrier, from liability when a permanently leased contract driver is not under dispatch.

What is Non-trucking Liability Insurance, (NTLI)?

Commonly referred to as bobtail insurance, NTL is liability insurance for the owner/operator when he is operating his commercial motor vehicle NOT under dispatch. NTL is in most cases, required by the motor carrier with whom the owner/operator has signed a lease agreement. This insurance fills a potential gap for non-business use of the equipment, and helps to protect the motor carrier’s primary liability policy. Non-trucking is not the same as bobtail insurance, so please verify with your motor carrier which coverage they require; in almost all cases, the requirement will be NTL.

Why do I need Non-Trucking Liability Insurance?

When an owner/operator leases on to a motor carrier, the commercial auto liability policy of that motor carrier will provide coverage while the owner/operator is under dispatch. However, since the leased operator owns the equipment, there are times when that vehicle may be operated not under dispatch; non-trucking liability provides coverage if you were to damage another person’s property or even injure them during personal use of your commercial vehicle.

When does non-trucking liability coverage kick in?

Generally speaking, non-trucking liability is coverage for non-business use and so, the motor carrier’s liability policy will cover you from the dispatch point, through pick-up and delivery and back to point of origin. Any personal use between your return, and the next dispatch should be covered under NTL.



REEFER INSURANCE

Companies specializing in the transport of refrigerated goods face unique challenges in acquiring insurance given the perishable nature of the commodities being hauled and the specialized refrigeration equipment used in trucks to prevent food spoilage.

MOTOR TRUCK CARGO INSURANCE

Motor Truck Cargo insurance (Cargo) provides insurance on the freight or commodity hauled by a For-hire trucker. It covers your liability for cargo that is lost or damaged due to causes such as fire, collision, or striking of a load.

If your load is accidentally dumped on a roadway or waterway (Removal Expenses coverage), our coverage pays for the cost to remove debris or extract pollutants caused by the debris. We’ll also pay for costs related to preventing further loss to damaged cargo (Sue and Labor Coverage), legal expenses in the defense or settlement of Claims’ and even freight charges the customer loses because of not delivering a load (Earned Freight Coverage).

Who needs motor truck cargo insurance?

A growing number of risk managers require truckers to insure their cargo. You can meet that requirement with Gold River  Motor Truck Cargo Insurance. It pays when you are responsible for damage to or loss of the cargo due to fire, collision or even hitting or running over the cargo that you transport on behalf of a client.

Limits, deductibles, and other details

When you select Motor Truck Cargo insurance, you have to select a limit for your coverage. This limit determines the maximum amount your insurance company will pay for damaged or destroyed cargo. You also need to choose a deductible. A deductible is the amount you agree to pay out of pocket when you have a claim. Choosing a higher deductible is an easy way to lower the price of your insurance, but be sure you choose a deductible that you can afford to pay out of pocket at any time.

Exceptions and restrictions

Motor Truck Cargo insurance is only available for for-hire trucking risks on policies with one or more of the following body types: dump truck, tractor, most trailers, box trucks, cement mixers, cargo vans, dually pickups, flatbeds and car haulers.

WHAT AM I REQUIRED TO MAINTAIN BY LAW?

There is no longer a federal mandate of cargo insurance for motor carriers who do not transport household goods. However, it is imperative that trucking companies purchase cargo insurance to adequately protect that goods transported. Many cargo insurance policies contain exclusions and deductibles which may limit insurance coverage. The typical coverage for a for-hire motor carrier is $100,000, but may increase based on commodities hauled and shipper or broker requirements.

In order to operate legally as a transportation broker, a freight broker bond is required by the FMCSA (Federal Motor Carrier Safety Administration). Also known as a Property Broker’s Surety Bond, BMC-84, or an ICC Bond.A surety bond is a contract between at least three parties:

  • The obligee – the party who is the recipient of an obligation (Federal Government)
  • The principal – the primary party who will be performing the contractual obligation, (Broker)
